1) Welcome to our website please read our terms and conditions carefully. The following conditions apply to the supply of goods and services provided by Waltons Television (Manx) Ltd and are designed to ensure that all of our customers can shop easily and with confidence when purchasing from Waltons. You must be of at least 18 years of age to purchase on this on-line site. Your use of this site indicates your acceptance of these terms and conditions. If you disagree with any part of these terms and conditions, please do not use our website. This website is for the purchase of goods for delivery within the Isle of Man only.

 

 

Acceptance of your Order:
 

 

2) In order to purchase goods from our site you are required to register your details with us, these details are subject to our privacy policy (12a to f) which is in accordance with the Data Protection Act 1998. Waltons Television (Manx) Ltd will only deliver goods to the cardholders name and address and all goods will need to be paid for in full or subject to finance clearance before delivery. Once payment has been received and confirmed or finance acceptance agreed you will receive an Email confirming the details of your purchase and delivery information. All delivered goods will require a signature upon delivery. We reserve the right not to fulfil your order for any reason, Including but not limited to product pricing and availability. Should any of these circumstances arise we will contact you as soon as possible to either amend or cancel your order or offer a full refund. Goods are only available for purchase and despatch within the Isle of Man.

3) Goods that you reserve online to be collected in store need to be paid for in full online before we can confirm your reservation.

 

 

Pricing:
 

 

4) All prices are in £ sterling and include VAT at the current rate. No contract is created until we have accepted your order. We retain the right to amend our advertised price at any time. The price shown on our website is the price you pay when you complete your order. Whilst we strive to ensure that all prices on our website are accurate, unfortunately errors may occur. If we discover an error in the price of your goods due to a typographical error or an error in pricing information received from a supplier we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you the order will not be processed. If you cancel your order and have already paid for the goods, you will receive a full refund.

 

 

Payment:
 

 

5) We accept most major credit cards /debit cards; these include Visa, MasterCard, Maestro, Visa Delta, Visa Electron & Switch. It will be necessary for the cardholder to provide full details including name, address and telephone number as registered with the card company/bank. Incorrect information will create a delay in the processing of your order. Your order will only be processed after authorization of your card provider/bank has been received. You may pay by cheque however we cannot despatch goods until your bank has cleared the payment, this delay may also affect the availability of the goods in question. Payment via credit/debit card may be made over the telephone if you prefer this method. Ownership and title in the goods remain the property of Waltons Television (Manx) Ltd until paid for in full.

 

 

Finance / Credit Facilities:
 

 

6) No deposit finance terms can be arranged through Black Horse Finance. You can submit your application for credit via our website; your application is then passed directly to Black Horse Finance who will process your application as swiftly as possible between the hours of: Monday – Friday 9.00am – 5.00pm all applications will be subject to status. If your Finance application is successful your order will be processed and you will then be required to sign the Finance Agreement and provide suitable proof of identity (proof of identity documents must be either a valid driving licence or passport) for inspection / copying to comply with regulations. Delivery / collection can then be arranged. Loans are subject to status and available to persons aged 18 years or over. The amount of the loan and the availability of certain credit products will depend on your credit assessment and personal circumstances. Waltons Charge Card facilities are available to qualifying customers (subject to status) with a credit limit of £1,500. Full terms and conditions are available in store.

 

 

Product Information:
 

 

7) All product specifications, images and product specific information are derived from the manufactures / suppliers and are updated on a regular basis to ensure accuracy, however specifications are subject to change without notice from the manufactures and whilst we endeavour to keep them updated Waltons cannot guarantee the reliability or accuracy of the information contained in its pages. Further information can be obtained from the manufactures websites. Product images, descriptions and specifications shown are for guidance only; for example cabinet/case colours may vary, TV stands may differ from those supplied, remote control designs may vary during manufactures’ production runs etc. Some products may require set-up and/or assembly: for example TV’s, PVR’s and Surround sound/Audio equipment may need manually tuning. TV stands/cabinets may need assembly.

 

 

Delivery and Installation - Isle of Man only:
 

 

8) Our technical installation team will deliver most items Monday to Friday 9.00am to 5.30pm (special arrangements may be available if difficulties are experienced with the above times and must be agreed with a manager). Smaller items may be delivered via post or by courier. For courier delivered items it is your responsibility to check your goods upon delivery for shortages or damage, and to make a note of such damage to the cartons or the goods on the carrier’s consignment note when you sign for the goods or refuse delivery if the packing is badly damaged. If this is not done we are unable to take the matter up with the carrier company. In most cases delivery is free, however setup and installation may incur a charge, please see delivery information for further details.

 

 

Collection of Electrical and Electronic Product (WEEE):
 

 

9) You have a responsibility to dispose of Electrical and Electronic Equipment safely. There are several ways to do this, you can of course take the discarded item to your nearest Amenity site (there are convenient sites located all around the Island) there is currently no charge for this recycling service. Waltons will collect your old equipment for recycling however a small charge will be levied for this service – see delivery information for further details.

 

 

Product Guarantees / Warranties:
 

 

10) All products come with a manufactures twelve-month guarantee, unless otherwise stated, from the date of invoice. The manufactures guarantee covers electronic/technical failure caused by a malfunction, it does not cover installation, tuning, configuration, accidental damage, neglect, misuse, broken trims/cases/cabinet parts/keypads, virus/software issues, consumables and routine maintenance or if the equipment has not been used in accordance with the manufactures instructions. Manufactures extended warranties are sometimes offered as part of a specific sales promotion, in such cases the customer must register the product directly with the manufactures within a set time limit. Waltons are official Service Centres/Agents for most products it sells, however some manufactures offer an on site or direct warranty service whereby the fastest remedy can be achieved through direct contact with the manufacturer. Should customers experienced any difficulty with manufactures direct warranty services Waltons will use its best endeavors to resolve the issue.
Any goods or equipment purchased from the Company and subsequently moved off the Island whilst under warranty. The Company will use its best endeavors to locate a manufactures service agent in the area where you have relocated to effect warranty repairs, however this may not always be possible. Whilst the Company will honor the warranty on the aforementioned products it will not be liable for any shipment, transit or insurance cost to return the goods to and from the Isle of Man for remedial work to be undertaken whilst under warranty.

12) Waltons Television (Manx) Ltd is committed to ensuring that your privacy is fully protected and any information gathered lawfully about you will be handled in (accordance with the Data Protection Act 1998). Should we ask you to provide certain information by which you can be identified when using our website; you can be assured that it will only be used in accordance with this privacy statement? Waltons Television (Manx) Ltd may amend this policy from time to time by updating this page. You should check this page for updates to ensure you are fully versed with any policy changes. This policy is effective from 01:01:2011.
 

a) Data we collect: For a typical transaction we will hold the following details – Name, Address & postcode, your credit/debit card details, telephone numbers and Email address. Credit transactions may require further details such as your occupation, employer, bank details, how long at current address and possibly a reference. Finance agreements prepared for consideration and sent by us to third parties such as B.H.F. will contain much of the above information, they too will have security polices in place to ensure your privacy.
 

b) Manufactures Extended Warranties: It is necessary following the purchase of certain items on promotional manufactures 5-year warranties to supply details of your purchase including your name, address and postcode for registration purposes. You may be contacted directly by the manufacture for confirmation of repairs carried out under warranty.
 

c) What we do with the information we gather: Primarily we require this information to fulfil your order and secondly to understand your needs and to provide you with a better service. We may periodically send promotional Email about new products and services, special offers or other information, which we think you may find interesting using the Email address, which you have provided.
 

d) Security: We are committed to ensuring that your personal information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard the information we collect on line.
 

e) Links to other websites: Our website may contain links to enable you to easily visit other websites of interest. However once you have used these links to exit our site you should note that we do not have any control over third part websites. Therefore, we cannot be responsible for the protection and privacy of any information, which you provide whilst visiting third part sites and this privacy statement does not govern such sites.
 

f) Controlling your personal information: You may wish to restrict the collection or use of your personal information in the following ways. If you have previously agreed to us using your personal information for direct marketing purpose, you may change your mind at any time by writing to us or emailing us. We will not sell, distribute or lease your personal information to third parties unless we have your permission to do so. You may request details of personal information we hold about you under the Data Protection Act 1998.

 

 

Cancellation and Returns:
 

 

13) You may cancel your order at any time prior to delivery or despatch; we will issue a full refund of the amount paid or a store credit note if applicable. It is your responsibility to ensure that the goods are complete and in working order. If you are not satisfied with your purchase you must inform us within 7 days of receipt of the goods. Goods must be returned in their original packaging together with all accessories, manuals and blank warranty forms. We reserve the right to make a charge for any damage made whilst the goods were in the ownership of the customer or to refuse the goods if they are deemed unsuitable for resale.

 

 

Limitations of Liability:
 

 

14) The following provisions set out the entire financial liability of the Seller (including any liability for the acts or omissions of its employees, suppliers, agents and sub-contractors) to the Customer in respect of any breach of these terms except for those losses, which are a foreseeable consequence of the failure to comply with these terms.
a) any breach of these conditions;
b) any use made or resale by the Customer of any of the products, or any product incorporating any of the products; and
c) any representation, statement or tortuous act or omission including negligence arising under or in connection with the contract.
d) Nothing in these conditions excludes or limits the liability of the Seller:
e) for death or personal injury caused by the Sellers negligence: or
f) under the Sale of Goods Act 1983 / Fair Trading (amendment) Act 2001.
g) for any matter which it would be illegal for the Seller to exclude or attempt to exclude its liability; or
h) for fraud or fraudulent misrepresentation.
i) Subject to condition d) and condition i)
j) the Seller’s total liability in Contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance of the Contract shall be limited to the Contract price; and
k) the Seller shall not be liable for any direct, Indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, loss of data, loss of time, depletion of goodwill and similar loss), costs, damages, charges or expenses.


 

Events out of the Company’s control:
 

 

15) Waltons Television (Manx) Ltd will not be liable or responsible or deemed in breech of any failure to perform by reason of any delay in performance or any failure to perform our obligations relating to the contract, if the delay or failure was due to any cause beyond Waltons reasonable control (Force Majeure Event) including; without limitation:

 

1. Acts of God, fire, explosion, storm, earthquake, subsidence, natural disaster, epidemic or flood.
2. Strikes, lockouts or other industrial action.
3. Civil commotion, riot, invasion, terrorist attack, or threat of terrorist attack or war.
4. Impossible use of shipping lines. Airlines, railways, motor transport or public highways.
5. Impossible use of public or private telecommunication networks or the Internet.
6. Severe weather conditions
7. Acts, restrictions, regulations, byelaws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority.

 

Our obligations are suspended for the duration/period that the Force Majeure Events persists.

16) It is a priority within our organisation to provide the highest level of service possible however sometimes mistakes can occur, when brought to our attention we will do our utmost to rectify the problem quickly and efficiently.
